    REFUSED TO PAY DETENTION

    Reason: Accessorial non payment (detention, TONU, lumper, layover, redelivery)

    We booked this load with Jill New and her team out of Dallas. Our driver checked in at 1:00 PM and was not loaded until 5:00 PM, resulting in four (4) hours on site. Detention was properly requested; however, only $30 was paid. We were advised that because the pickup window was 12:00–4:00 PM, detention only applies after 4:00 PM regardless of the driver’s actual check-in time. We do not agree with this position. Standard industry practice is to calculate detention based on the documented check-in time, not solely the end of a pickup window. A pickup window does not negate detention liability once the driver is checked in and available to load. Given a 1:00 PM check-in and a 5:00 PM load time, the driver exceeded the standard free time allowance. The partial detention payment does not adequately compensate for the delay incurred. We are requesting a full review and adjustment of detention pay in accordance with industry standards. Please advise when this will be corrected.

    I booked a load with Jill New and her team. My driver was sitting at their shipper in Dallas for three days waiting to be loaded. We were paid for one day of layover, and at that time we were advised that an additional day of layover would also be paid. After the load was delivered, we were informed that the second day of layover would not be paid. This contradicts what was previously communicated to us. Please review this matter and advise on the payment for the additional layover day.
